These Terms of Service ("Terms") govern your use of the Nora mobile application ("App"), operated by Axiom One LLC ("we," "us," or "our"). By downloading, installing, or using Nora, you agree to these Terms.
01What Nora Does
Nora is a check-in app that uses quiet phone activity, home/away context, and battery context from a Loved One's phone so Guardians can know when something seems off.
Nora is NOT:
- A medical product, diagnosis tool, or health care service
- A 911 service, dispatch service, or medical response system
- A live map, route history, or tool for following someone
- A replacement for direct communication with your Loved One or professional care
02Eligibility
You must be at least 18 years old to create a Nora account. By using the App, you represent that you are at least 18 years of age.
03Accounts and Roles
3.1 Account Creation
You may create an account using your email address. You are responsible for maintaining the security of your account credentials and for all activity under your account.
3.2 Roles
- Guardians set up Homes, invite Loved Ones, manage check-in settings, and receive Nora messages when something seems off.
- Loved Ones are invited by Guardians and consent to Nora check-ins from their phone.
3.3 Consent
By inviting a Loved One to Nora, the Guardian represents that they have obtained the Loved One's informed consent to use Nora check-ins. Setting up Nora on someone's phone without their knowledge or consent is a violation of these Terms and may violate applicable laws.
04Acceptable Use
You agree NOT to:
- Use Nora for anyone without their informed consent
- Use Nora to follow, stalk, or harass anyone
- Attempt to access another Home's information
- Reverse-engineer, decompile, or tamper with the App
- Use the App for any illegal purpose
- Abuse Nora messaging (e.g., adding false backup contacts)
- Attempt to circumvent security measures, including Row Level Security
We reserve the right to suspend or terminate accounts that violate these Terms.
05Subscriptions and Payments
Nora is offered as a subscription through the Apple App Store. Current pricing and plan details are shown in the App at the time of purchase. Refunds are handled by Apple in accordance with their refund policies.
06Nora Messages
6.1 How Nora Messages Work
Nora uses quiet phone check-ins and lets Guardians know when the Home's configured check-in timing windows are reached. Guardians can adjust those timing windows in Settings. Sign-in codes via text are included for all accounts. Availability of SMS nudges and wellness alerts may depend on your subscription plan.
By providing your phone number and opting in, you consent to receive automated text messages from Nora, including sign-in codes, check-in nudges, and wellness alerts. Message frequency varies. Message and data rates may apply. Reply STOP to any message to opt out, or HELP for assistance. Opting out of SMS does not affect push notifications or your subscription.
6.2 Nora Message Limitations
Nora messages are informational, not 911 or response services. Specifically:
- Messages depend on the Loved One's phone being powered on, connected to the internet, and able to run Nora
- False concern messages can occur (phone off, airplane mode, app killed by iOS, no internet)
- Missed messages can occur (push delivery failures, SMS delivery issues, phone in Do Not Disturb)
- Message delivery depends on third-party services (Apple Push service, Twilio for SMS) which may experience outages
- Check-in timing windows are not medical measurements — they indicate phone inactivity, not a health condition
6.3 Not a Substitute for Care
Nora is a supplemental awareness tool. It does not replace:
- Regular in-person check-ins
- Medical response products or services
- Professional caregiving or home health services
- 911 or other response services
07Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Nora is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied
- We do not guarantee that Nora messages will be delivered on time, or at all
- We do not guarantee continuous, uninterrupted, or error-free operation
- We are not liable for any damages arising from missed messages, delayed messages, false concern messages, or reliance on the App
- We are not liable for any injury, harm, or death that may occur to a Loved One, regardless of whether the App was in use
- Our total liability for any claim related to the App shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $50, whichever is greater
08Indemnification
You agree to indemnify and hold harmless Axiom One LLC and its members, officers, agents, contractors, and service providers from any claims, damages, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third party's rights
- Using Nora for someone without their consent
- Any claim by a Loved One or their representatives
09Privacy
Your use of Nora is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
10Account Termination
10.1 By You
You may delete your account at any time from within the App (Settings → Delete Account). This permanently removes your information as described in the Privacy Policy.
10.2 By Us
We may suspend or terminate your account if:
- You violate these Terms
- We reasonably believe you are using the App to harm others
- Required by law
- We discontinue the service
10.3 Effect of Termination
Upon termination, your right to use the App ceases immediately. Information deletion follows the process described in the Privacy Policy.
11Intellectual Property
The Nora app, including its code, design, and content, is the property of Axiom One LLC. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose.
You may not copy, modify, distribute, sell, or create derivative works based on the App without explicit written permission.
12Modifications to the Service
We reserve the right to modify, suspend, or discontinue any aspect of Nora at any time, with or without notice. We will make reasonable efforts to let active users know about significant changes.
13Changes to These Terms
We may update these Terms from time to time. When we make material changes:
- We will update the "Last Updated" date
- We will let you know via the App or email for significant changes
- Continued use after changes constitutes acceptance
- If you disagree with updated Terms, your remedy is to stop using the App and delete your account
14Governing Law
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the App shall be resolved in the courts of Fulton County, Georgia.
15Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.
